Opt-in Email, In’s and Out’s

Opt-in email is when a consumer is given the option to receive “bulk” email; usually advertisements or promotions from businesses.  There are two very common forms of opt-in email, unconfirmed and confirmed.

Unconfirmed, opt-in email means that a consumer gives his/her email address to an email solicitor.  The solicitor, then proceeds to email that consumer without confirming that the email address is actually theirs.  Problems arise when malicious spammers forge or make-up email address and make it look like the owner of that address registered it with an email solicitor.

Confirmed, opt-in email happens when a consumer submits his/her email address to a business as a subscriber, and the business in turn sends him/her an email containing a weblink to confirm that the email address really does belong to them.  This level of email authentication is considered by many anti-spam advocates to be the minimum level necessary for all opt-in email advertising or other ongoing email communication.  Confirmed, opt-in email is also known as a confirmed subscription or a closed-loop opt-in.

According to FTC regulations, all email solicitations, confirmed or not, must offer instructions on how to opt-out of receiving future correspondence.
